U.S. Demurrage & Detention Updates – Effective April 1, 2023

Please note effective April 1, 2023, we will make several key updates to our Demurrage & Detention program for U.S. cargo. They are as follows:

1. These changes clarify that Sealand will only assess import demurrage, import detention, and export detention charges with respect to U.S. shipments only on days when the pickup or return location for equipment is open for the pick-up or return of equipment and cargo. These updates will streamline and simplify our approach to demurrage and detention and provide greater transparency to customers.
2. For the purposes of calculating free time, we will consider Monday through Saturday as working days provided the pickup or return location is open. We encourage you to review the operating schedules of the pickup and return locations you use.
3. In reviewing the impact of inflation on landside costs and in order to continue to incentivize cargo and equipment flow during terminal operating periods, demurrage and detention charges will have provided for a modest (average five percent (5%)) increase in our rates as per the levels attached to this advisory.
4. For import detention, we will by default issue detention invoices to consignees for both SD and CY delivery bills of lading. The current default is to issue SD invoices to the consignee and CY invoices to the motor carrier.
5. Demurrage free time at CSX rail ramps will reduce from 4 working days to 3 working days for CY deliveries. Please be reminded this is for equipment use only and storage remains settled directly with CSX for both SD and CY delivery cargo according to the rail ramps storage conditions.
6. For SD moves, where empty notification is being used, we will stop the detention clock based on the day we receive the notification. Currently we stop the clock the next business day.

In addition to the above, we wish to remind you Sealand has several options to assist you with managing your container flows and costs. If inventories require you to slow down your cargo, in-transit storage options including flex hub storage at transhipment hubs, and off dock depot storage at destination ports & rail yards can reduce more expensive storage options at ports, rail locations, or loaded at warehouses. In addition, destination container management programs, warehousing, customs clearance, trucking and additional discounted pre-paid detention free time options are also available.
